Purchase Terms and Order Placement

  1. All prices are stated in Polish zloty (PLN) and euro (EUR) and include value added tax (VAT). Prices do not include delivery costs. Any currency conversion fees shall be borne by the Customer.
  2. Orders may be placed via the website www.stakato.pl, by e-mail at stakato@stakato.pl, by telephone at +48 32 777 22 22, or in person at the Seller’s physical store.
  3. In the case of mail-order sales, the Customer is required to provide complete and accurate contact and delivery details.
    Note: Customers are requested to attach the correspondence history and use one consistent e-mail address in order to avoid potential misunderstandings.
  4. When placing an order at a distance, the Customer shall specify the model or product name and all material parameters, including but not limited to size, colour, and heel height.
  5. When placing a distance order, the Customer shall specify the selected payment method and delivery method.
  6. The Customer may use a discount code held by the Customer when placing an order. Discount codes may not be combined. Where more than one discount code is entered, the most advantageous discount for the Customer shall apply.
  7. Orders are delivered via Polish Post (national operator), Pocztex courier service, InPost Courier, or InPost Parcel Lockers. Delivery fees are flat-rate and include a handling charge.

  8. Delivery methods and costs within the territory of Poland:

a) Economy registered mail (available only for selected products) – PLN 6 (prepayment by bank transfer or via PayU)
b) InPost courier – PLN 16 (prepayment by bank transfer or via PayU)
c) InPost cash-on-delivery courier – PLN 20 (payable in cash upon delivery)
d) InPost Parcel Locker – PLN 14 (prepayment by bank transfer or via PayU)

9. International delivery methods and costs:
– international courier delivery – PLN 179
– international postal delivery – PLN 65

10. Available payment methods include:
– cash upon personal collection,
– cash on delivery (to the courier) or payment card at an InPost Parcel Locker,
– bank transfer (details set out in clause 14),
– PayU online payment system (bank transfer, BLIK, or payment card).

11. Estimated dispatch times depending on payment method:
– cash on delivery – dispatch within 48 business hours,
– bank transfer prepayment – dispatch within 48 business hours of receipt of funds,
– PayU payments – dispatch within 48 business hours of payment confirmation.

12. In the case of unavailable or custom-made products, dispatch times shall be extended. The Customer shall be informed thereof without undue delay.

13. Personal collection of orders is available at the Seller’s physical store located at ul. Lompy 2/4, Katowice (1st floor).

15. Where an invoice is requested, the Customer shall provide complete and accurate invoicing details.

16. The Seller reserves the right to refuse to dispatch more than two pairs of shoes in a single shipment. This limitation applies to products from the BALLROOM DANCE, BALLET, TRAINING, and VARIOUS STYLES categories.

17. The Seller reserves the right to refuse to process any order that raises reasonable concerns. The Customer shall be notified accordingly.

18. The Seller reserves the right to reject or cancel an order in the event of:
– provision of incorrect or incomplete order data,
– failure by the Customer to collect the shipment,
– failure to make payment within five (5) business days from order placement,
– failure to collect an order from the store within ten (10) calendar days where personal collection has been selected.

19. The Seller shall use reasonable efforts to ensure that product availability displayed on the website reflects actual stock levels. In the event of unavailability, the Customer shall be informed without undue delay.

20. By placing an order, the Customer confirms that they have read, understood, and accepted these Terms and Conditions.

Terms for Custom Orders

  1. The Customer may place a custom order for a product that is temporarily unavailable or not offered for continuous sale.
  2. Custom orders shall be priced individually based on information provided by the Customer. The price may differ from the standard price published on the website, of which the Customer shall be informed prior to order confirmation.
  3. For footwear or clothing, the Customer shall provide the required size or individual measurements in centimetres, together with all other parameters necessary to fulfil the order.
  4. A deposit equal to fifty per cent (50%) of the total order value shall be required to commence production. The remaining balance, together with any applicable delivery costs, shall be payable upon completion of the order, prior to collection or on the date of collection.
  5. Provided measurements do not constitute a guarantee of perfect fit. Additional adjustments may be required in certain cases.
  6. In the event of cancellation of a custom order more than twenty-four (24) hours after placement, the deposit shall be non-refundable.
  7. The manufacturer reserves the right to withdraw from the contract within thirty (30) calendar days of order placement.
  8. Products are manufactured in accordance with established standards. Any individual modifications requested by the Customer shall be subject to additional charges.
  9. Leather footwear may exhibit natural creases and irregularities inherent to the material.
  10. Footwear manufactured using materials supplied by the Customer may differ in finishing quality from footwear produced using the manufacturer’s materials.
  11. In the case of footwear fitted with a poly-rubber sole, any adjustments requiring sole removal shall not be possible.

Returns, Exchanges and Complaints

1. Returns (Withdrawal from the Contract)

a) A Customer who has concluded a distance contract shall be entitled to withdraw from the contract within fourteen (14) days without stating any reason and to receive a refund, except for cases specified in Chapter 4 of the Consumer Rights Act of 30 May 2014.
b) The Customer shall return the goods without undue delay and no later than fourteen (14) days from the date on which the withdrawal notice was submitted.
c) Statutory exclusions from the right of withdrawal pursuant to the Consumer Rights Act of 30 May 2014 (Journal of Laws 2014, item 827), in particular Article 38, provide that the right of withdrawal shall not apply to contracts:
“for the supply of non-prefabricated goods manufactured according to the consumer’s specifications or serving the consumer’s individualised needs.”
In practice, the right of withdrawal applies exclusively to mass-produced goods sold “off the shelf,” provided that the order was not fulfilled according to individual specifications of the Customer and the returned goods show no signs of use.

Important: The Seller does not collect parcels from Parcel Lockers on weekends, public holidays, or days between public holidays. In such cases, there is a risk that the parcel will be returned to the sender.

e) The cost of returning the goods shall be borne by the Customer. Cash-on-delivery return shipments shall not be accepted.
f) Returned goods must be accompanied by proof of purchase and a completed return form, available for download on the Seller’s website.
g) Refunds shall be processed via the PayU payment platform or by bank transfer to the bank account specified by the Customer.
h) Customers are encouraged to place well-considered orders. In accordance with best customer service practices, the Seller makes every reasonable effort to ensure that the footwear supplied is properly fitted and of the highest quality offered.
i) Custom-made footwear is non-refundable, and withdrawal from the contract is excluded, in accordance with applicable law.

2. Exchanges

a) Footwear should be tried on a clean surface in compliance with basic hygiene rules. Exchanges are permitted solely in respect of new, unused products that show no signs of wear.
b) The Customer shall notify the Seller of the intention to exchange a product within fourteen (14) days from the date of receipt of the order. Following confirmation of exchange availability, the product shall be returned within five (5) days.
c) In order to exchange a product, the Customer shall specify the parameters of the product requested in exchange. The Seller shall confirm the availability of the requested product. The Customer is requested not to return the product prior to notifying the Seller and receiving confirmation.
d) Products intended for exchange shall be returned to the address indicated above. Returns may also be sent to the InPost Parcel Locker specified above.
e) The cost of returning the product for exchange shall be borne by the Customer. Cash-on-delivery shipments shall not be accepted.
f) The cost of reshipping the exchanged product shall be PLN 14 (courier delivery) or PLN 12 (Parcel Locker). For small items, a lower-cost shipping option may be available upon prior consultation with the Seller.
g) Returned products must be accompanied by a withdrawal statement and proof of purchase. Failure to provide these documents may result in rejection of the Customer’s claim.

2. Warranty and Complaints

a) The basis and scope of the Seller’s liability towards the Customer shall be governed by generally applicable provisions of law, in particular the Consumer Rights Act and the Polish Civil Code.
b) The Seller grants a six (6)-month warranty for footwear, covering the following defects:

  • detachment of the sole (excluding mechanical tearing),
  • seam failures,
  • fraying of material,
  • hidden material defects.

c) The warranty shall not apply to footwear exhibiting excessive wear.
d) The warranty shall not cover damage resulting from natural wear and tear, improper use, or improper maintenance, including but not limited to:

  • damage to heel blocks and heels in Irish step dance shoes,
  • abrasion or damage to rubberised leather soles,
  • wear of heel tips,
  • discolouration of leather soles,
  • lining dye transfer,
  • sole abrasion,
  • damage, discolouration, or alteration of properties resulting from washing footwear.

e) Wetting suede soles in dance footwear shall result in loss of warranty coverage.
f) Complaints may be submitted:

  • in person at the Seller’s physical store (ul. Lompy 2/4, 1st floor).

g) It is recommended that a complaint description include the following information:

  • Customer’s full name and contact details,
  • product name and date of purchase,
  • description of the defect and the date of its occurrence,
  • the Customer’s request regarding complaint resolution.

h) A condition for accepting a footwear complaint is the submission of proof of purchase and footwear that is clean, brushed, and properly aired.
i) The Seller shall respond to a complaint within fourteen (14) calendar days from the date of its submission.
j) The Seller shall be liable for non-conformity of consumer goods with the contract if such non-conformity is discovered within two (2) years from the date the goods were delivered to the Customer.

Personal Data Protection

  1. The Seller processes personal data in accordance with applicable data protection legislation.
  2. By placing an order, the Customer consents to the processing of personal data for the purposes of order fulfilment and, where applicable, marketing communications.
  3. Personal data may be disclosed to third parties solely to the extent necessary to perform the contract or comply with legal obligations.
  4. The Customer has the right to access, rectify, erase, and restrict the processing of their personal data, as well as to opt in or out of receiving newsletters at any time.

Governing Law and Jurisdiction

These Terms and Conditions and any contracts concluded pursuant thereto shall be governed by and construed in accordance with the laws of the Republic of Poland.

Any disputes arising out of or in connection with these Terms and Conditions or contracts concluded between the Seller and the Customer shall be subject to the jurisdiction of the competent Polish courts.
